These Terms of Service (“Terms”) govern your access to and use of the website cognaisec.com and the products, AI agents, services and training offered by Cognaisec (“we”, “us”, “our”). By using our website or services, you agree to these Terms. If you do not agree, please do not use them.
If you use our services on behalf of a company, you confirm that you have authority to bind that company, and “you” includes it.
Our Services
Cognaisec provides an AI Powered Cyber Security Platform, including:
- AI agent bug bounty hunting on bug bounty platforms
- AI agents for automated security tasks
- AI agents that test vibe-coded applications
- Human hackers who train your AI agents
- Cybersecurity and AI blended training
- Related products, tools and content
Specific engagements may be governed by a separate written agreement, statement of work or quote (“Service Agreement”). If a Service Agreement conflicts with these Terms, the Service Agreement prevails for that engagement.
Eligibility
You must be at least 18 years old and legally able to enter into a binding contract. Our services are intended for businesses and professionals.
Authorization for Security Testing
Security testing is only lawful when you have permission to test. For any engagement, you confirm and agree that:
- You own, or have written authority from the owner to authorize testing of, every system, application, domain, API and asset in scope.
- You will provide a clear written scope, including targets, permitted methods, testing windows and any exclusions.
- You will inform any relevant third parties (hosting providers, cloud vendors, bug bounty platforms) where their approval is needed.
- You are responsible for any consequences arising from testing assets you did not have the right to authorize.
We may refuse, pause or stop any engagement we reasonably believe is unauthorized, unlawful or outside agreed scope.
AI Agent Services and Limitations
- Our AI agents may produce incomplete, inaccurate or false-positive results. Findings should be reviewed and validated before action is taken.
- Testing, including by automated agents, can occasionally cause service disruption, performance impact or data changes in target systems. You are responsible for backups and for testing against production only at your own risk and as agreed in writing.
- Our services do not guarantee that your systems are free of vulnerabilities, or that they cannot be breached.
- We do not guarantee that bounties, rewards or payouts will be obtained from any bug bounty platform. Platform rules, triage decisions and payouts are outside our control.
Bug Bounty Activity
Where our agents or team hunt on bug bounty platforms on your behalf or ours, we follow each program’s rules and scope. Reward sharing, ownership of reports and platform account arrangements will be set out in your Service Agreement.
Acceptable Use
You agree not to:
- Use our services, tools or agents to attack, damage or gain unauthorized access to any system.
- Provide targets you are not authorized to test.
- Reverse engineer, copy, resell or attempt to extract the models, prompts, source code or methods behind our platform, except as law permits.
- Interfere with the website’s security or operation, or attempt to bypass access controls.
- Upload malware or unlawful content, or use our services to violate any law or third-party right.
- Use our outputs or training material to develop or deploy malicious tools.
We may suspend or terminate access for any violation.
Accounts and Training
If you register for training or a platform account, you must give accurate information, keep your credentials confidential, and are responsible for activity under your account. Training content is for your own or your organization’s authorized use only and may not be shared, recorded or redistributed without our written permission. Training sites such as training.cognaisec.com may have additional terms.
Fees and Payment
- Prices, billing schedules and payment terms are set out in your quote or Service Agreement.
- Unless stated otherwise, fees are due within 30 days of invoice, are non-refundable, and exclude applicable taxes.
- Late payments may incur Late fee at 1.5% per month or the maximum permitted by law, and we may suspend services until payment is received.
Confidentiality
Each party will keep the other’s non-public information, including source code, vulnerability findings, credentials and business information, confidential, use it only for the engagement, and protect it with reasonable care. This does not apply to information that is public, independently developed, or required to be disclosed by law. Vulnerability reports are shared only with you, or with a bug bounty platform you have authorized. Our handling of personal data is described in our Privacy Policy.
Intellectual Property
- Ours: The website, platform, AI agents, models, tools, methods, training materials, logo and branding belong to Cognaisec and its licensors. We grant you a limited, non-exclusive, non-transferable right to use them for their intended purpose.
- Yours: You keep ownership of your systems, code and data. You grant us a limited right to access and use them solely to deliver the services.
- Reports: Unless your Service Agreement says otherwise, you own the final vulnerability reports delivered to you, while we keep our underlying tools, techniques and general know-how.
- Feedback: Suggestions you give us may be used freely to improve our services.
Third-Party Links and Services
Our site links to third-party sites, including our blog at bughuntinginsights.com, and may rely on third-party tools and platforms. We do not control them and are not responsible for their content or practices.
Disclaimer of Warranties
The website and services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.
- Our total liability for any claim relating to the services will not exceed the fees you paid us in the 12 months before the claim arose, or $100 if you paid no fees.
Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to defend and indemnify Cognaisec against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your lack of authorization over tested assets, or your misuse of our services.
Termination
You may stop using the services at any time. We may suspend or terminate access immediately if you breach these Terms or if required by law. Sections that by nature should survive (confidentiality, intellectual property, payment, disclaimers, liability limits and indemnification) will remain in effect after termination.
Changes to These Terms
We may update these Terms from time to time. The “Last updated” date shows the latest version. Continued use of the website or services after changes means you accept the updated Terms. Material changes to an active engagement will be agreed in writing.
Governing Law and Disputes
These Terms are governed by the laws of country, without regard to conflict-of-law rules. Disputes will first be addressed through good-faith negotiation, and if unresolved, will be submitted to the courts of country.
General
These Terms, together with the Privacy Policy and any Service Agreement, form the entire agreement between us. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business.
